The restricted number of ownership interests associated with each property supports a sense of place, a connection with the community and a true pride of ownership.

Fractional ownership is a recorded and undivided deeded interest in a property, providing all the benefits and privileges of second home or investment property ownership. The property is typically professionally managed, relieving owners of the costly burden and responsibility of care and maintenance upkeep. Fractional ownership is an insured property interest with legal and financial separation between owners.

Fractional interest private co-ownership title is evidenced by a fee simple deed, recorded and guaranteed by a title insurance policy. Like any other form of real estate, the owner's undivided deeded interest can be sold or transferred by the owner, or sold by a licensed real estate Broker.

Fractional property ownership has been in use for more than 20 years. According to CNN Money, fractional ownership became a fast growing segment of vacation home ownership in ski destination areas of Utah over 10 years ago. Like other desirable destination areas, expensive homes were under-utilized, costing property owners significant sums of money for only a few weeks or months of use.

Today fractional ownership is a popular and widely accepted form of property ownership in Tahoe and most Colorado ski destinations. CNN Money reported in 2006 that more than half of all real estate sales in Aspen, Colorado involved fractional ownerships. Fractional ownership is one of the fastest growing forms of second home ownership. Colorado ranks first among the destinations in the United States, followed by Florida, Hawaii, California and Nevada.

Fractional ownership is an investment in a property's potential increase in value, offering equity participation in appreciation. Unlike a traditional time share where approximately 50% of the value goes to marketing, commissions, promotions, give-a-ways and other fees and expenses; the costs to sell and advertise fractional ownership interests are significantly less. For these and other reasons, traditional time shares typically decrease in value while fractional ownership interests usually appreciate.

In 2002, the IRS ruled TIC fractional interests could be used as a replacement property in a 1031 Exchange; allowing people to buy and sell interests in vacation homes as investment properties as well as second homes.


Prospective buyers and sellers are encouraged to consult with and engage qualified tax advisors and seek legal advice pertaining to fractional ownership for personal, business, and/or investment purposes and/or IRS 1031 tax deferred exchange qualifications and/or second home expense deductions that may apply to each individual's specific state of affairs.


                                                OWNERSHIP and CONTROL

Ownership and control are two factors separating private fractional ownership interests from time shares and destination clubs. Dwell Napa Valley LLC specializes in structuring, coordinating, and facilitating private fractional offerings, usually limited to five or fewer owners, affording the maximum benefit of control.

A Private Residence Club (different from a Destination Club) is a form of fractional ownership whereby an owner generally has minimal control of fees, "over servicing", and other costs set at the discretion of management. Private Residence Club owners do not typically own and occupancy a specific residence; owners are assigned to any of the variety of different residences located on the property, subject to change with each occupancy period. The Dwell Napa Valley fractional ownership model is different than the Private Residence Club or Destination Club structure. Each property is unique and so are individual Buyers and Sellers. Dwell Napa Valley LLC coordinates objective evaluations on a case by case basis. Services are available to assist property owners in evaluating the sale of their property structured as fractional ownership. Similarly, each potential buyer and/or investor’s interest is analyzed to determine which properties may fulfill their needs and meet the individual requirements.
